To Whom It May Concern:

The City of Garden Grove (the "City") has completed its initial review of your July 13, 2016, request for copies of all outgoing emails sent by Police Sgt. James Colegrove and Police Sgt. James Fischer for the last year. This letter shall serve as the City's notice of determination as to whether your request calls for the disclosure of non-exempt and non-privileged public records in the possession of the City, pursuant to the California Public Records Act (the "ACT") (Government Code Section 6250, et seq.). The City's determination in this regard is as follows:

To the extent your request seeks law enforcement investigatory records, peace officer personnel records, and records containing the identity of complainants, these records are protected from disclosure and will not be produced. (Gov't Code §6254(f); Gov’t Code§6254(k); Penal Code §§832.7 and 832.8; Evidence Code §§1043-1045; Gov't Code §6255; City of San Jose v. Superior Court of Santa Clara County (San Jose Mercury News, Inc.), 74 Cal.4th 1008 (1999)) Records containing cellular telephone numbers for police department employees will be produced in redacted form, as these numbers are not intended for use by the general public. (Gov't Code §6255) Notwithstanding the foregoing, the City is in possession of non-exempt, non-privileged, disclosable public records responsive to your request. The City is still in the process of reviewing and redacting the records responsive to your request. We anticipate the responsive records will be available for you on or before September 5, 2016.

Re: Request for Public Records – Notice of Extension
City of Garden Grove

To Whom It May Concern:

The City of Garden Grove has received your records request dated July 13, 2016, requesting copies of all outgoing emails sent by Police Sgt. James Colegrove and Police Sgt. James Fischer for the last year. This letter shall serve as notification of the City’s intent to comply with your request for public records, pursuant to the California Public Records Act (the “Act”) (Government Code §6250 et seq.).

The City is in the process of evaluating this request and is compiling records in an effort to make a determination as to whether the request seeks copies of disclosable public records in the possession of the City of Garden Grove. However, notice is hereby given that the time limit to make this initial determination under the code shall be extended by fourteen (14) days to August 8, 2016, pursuant to Government Code §6253, for the following reasons:

(a) The extension of time is reasonable and necessary for the proper processing of the request.

b) The request, as written, delineates multiple request category descriptions. Consequently, there is a need to collect, and appropriately examine a voluminous amount of separate and distinct records that are demanded in a single request.

As noted above, the City’s written determination as to whether the request seeks copies of disclosable, non-exempt and non-privileged public records in the possession of the agency shall be sent to you on or about August 8, 2016. Pursuant to the Act, thereafter any and all disclosable, non-exempt and non-privileged public records that are deemed responsive to your request will be made promptly available to you.
