Re: Request for Public Records - Notice of Determination

Dear Ms. Simoneaux-Cuaso,
The City of Garden Grove (the "City") has completed its initial review of your May 15, 2017, request for for copies of all documents sent to or received from Land & Design, Inc. during the period of January 1, 2010 through December 31, 2010 related to Site "C". This letter shall serve as the City's notice of determination as to whether your request calls for the disclosure of non-exempt and non-privileged public records in the possession of the City, pursuant to the California Public Records Act (the "ACT") (Government Code Section 6250, et seq.). The City's determination in this regard is as follows:
Records deemed responsive to your request have been located and are determined to contain responsive non-exempt, non-privileged information under the Act. City staff is, however, still in the process of gathering and assembling the requested documents. City staff anticipates completing the document review and making the documents available to you on or before Thursday, June 22, 2017.

Dear Ms. Simoneaux-Cuaso:
The City of Garden Grove has received your records request dated May 15, 2017, requesting copies of all documents sent to or received from Land & Dsign, Inc. during the period of January 1, 2010 through December 31, 2010 related to Site "C". This letter shall serve as notification of the City’s intent to comply with your request for public records, pursuant to the California Public Records Act (the “Act”) (Government Code §6250 et seq.).
The City is in the process of evaluating this request and is compiling records in an effort to make a determination as to whether the request seeks copies of disclosable public records in the possession of the City of Garden Grove. However, notice is hereby given that the time limit to make this initial determination under the code shall be extended by fourteen (14) days to June 8, 2017, pursuant to Government Code §6253, for the following reasons:
(a) The extension of time is reasonable and necessary for the proper processing of the request.
(b) Responsive records, to the extent they exist, may be located in several different departments.
As noted above, the City’s written determination as to whether the request seeks copies of disclosable, non-exempt and non-privileged public records in the possession of the agency shall be sent to you on or about June 8, 2017. Pursuant to the Act, thereafter any and all disclosable, non-exempt and non-privileged public records that are deemed responsive to your request will be made promptly available to you.

The City cannot respond to your request because it is vague, ambiguous and over-broad. Government Code 6253 requires that a request reasonable describe an identifiable record or records. Your request is not clear as to who at the City received the records requested, or who at the City sent the records requested, to the persons listed in the request. Furthermore, the request needs to clarify whether it seeks records sent/received only on one day, January 1, 2010.
Please further note that a request that requires an agency to search an enormous volume of data, or which compels the production of a huge volume of material is objectionable if the agency cannot locate or produce the requested information with reasonable effort. For that reason, we suggest that you identify the specific City employee who may have corresponded with the named individuals and to limit your request to a reasonable time period, such as six months to one year.
