RE: Public Records Act Request- Garden Grove-Owned Real Property Located in the City of Santa Ana; Notice of Determination
The City of Garden Grove ("City") has completed its review of your March 21, 2019 request for public records. This letter will serve as the City's notice of determination as to whether the request, in whole or in part, seeks the production of non-exempt, non-privileged disclosable public records in the possession and control of the City pursuant to the California Public Records Act (Government Code §§ 6250 et seq.) (the "Act"). The City has evaluated the 16 general request category descriptions set forth in your letter in an effort to make a determination as to whether the request seeks copies of disclosable public records in the possession and control of the City. The City's determination in this regard is as follows:
1. All Records that refer or relate to the City’s ownership of the Willowick Golf Course, located at 3017 West 5th Street, Santa Ana, California 92703-1898, from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
2. All Records that refer or relate to the source of funds used to acquire the Willowick Golf Course from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
3. All Records that refer or relate to the acquisition of the Willowick Golf Course by the City of Garden Grove from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.

4. All Inventories that include or refer to the Willowick Golf Course and all Records that refer to any Inventory or its preparation regarding the Willowick Golf Course, including staff reports, Planning Commission agendas and minutes, City Council agendas and minutes, resolutions, and ordinances, from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
5. All Records, including but not limited to, deeds, purchase and sale agreements, or any other conveyance document related to the Willowick Golf Course from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
6. All Records that constitute, reflect, or refer to any written offer by the City to sell, lease, or otherwise transfer the property at Willowick Golf Course to any person or entity, public or private, or nonprofit from January 1, 1980, to the present.
The City does not have records responsive to this request.
7. All Records that constitute, reflect, or refer to any Requests for Proposals relating to Willowick Golf Course that the City sent to any person or entity, public, private, or nonprofit from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
8. All communications the City sent to, or received from, any person or entity, public, private or nonprofit, that refers, relates to, or mentions the Willowick Golf Course from January 1, 1980 to the present.
This request is objected to on the grounds that, as phrased, is vague, overly broad and unduly burdensome. Note that in Rogers v. Superior Court, (1993) 19 Cal. App.4th 469, 481, the Court held that requests for public records must be focused and specific. Perhaps you might want to specify whether the communications you are interested in relate to a specific topic, event, or date.
9. All Documents referring or relating to the City of Garden Grove's parcel designation of the Willowick Golf Course as remnant, excess, or surplus land from January 1, 1980, to the present.
The City has no documents responsive to this request.
10. All Documents referring or relating to any cooperative agreements between the City of Garden Grove and the City of Santa Ana regarding the operation of the Willowick Golf Course, from January 1, 1980, to the present.
This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
11. All Documents referring or relating to any cooperative agreements between the City of Garden Grove and the City of Santa Ana regarding the use of the Willowick Golf Course, from January 1, 1980, to the present.

This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.

This request is objected to on the grounds that, as phrased, is overly broad and unduly burdensome. Records going back to 1980 are not electronically retained, may be in boxes in storage, may be in microfiche, not easily found or retrieved, and may be voluminous in scope.
Notwithstanding the foregoing objections, the City will produce non-exempt, non-privileged disclosable public records in the possession and control of the City that are deemed responsive, or potentially responsive, to the extent that it is readily located.
15. All Records, Communication(s), and Document(s) from the period of time of January 1, 1980 to the present that refer or relate to the City’s classification of the City-owned property, Willowick Golf Course as “excess”, “remnant”, or “surplus”.
The City has no documents responsive to this request.
16. All Records, Communication(s), and Document(s) that refer or relate to the City's implementation, interpretation of, and compliance with Government Code Sections 54220 et seq., including all reports, memorandum, correspondence, and other records, from the period of time of January 1, 1980 to present, including but not exclusive to the Willowick Golk [sic] Course.
The City interprets this request as applying to all properties it owns or has ever owned and as such this request is objected to on the grounds that it is vague, overly broad and unduly burdensome. Note that in Rogers v. Superior Court, (1993) 19 Cal. App.4th 469, 481, the Court held that requests for public records must be focused and specific. Perhaps you might want to specify a specific property and limit the request to a specific date or event.
Notwithstanding the foregoing determination, records will not be produced, or may be redacted, to the extent they are determined to be exempt from disclosure pursuant to: the attorney-client privilege and the attorney work product doctrine (Government Code §6254(k), Evidence Code §954, Code of Civil Procedure §2018.030); the public interest exemption and common law deliberative process privilege (Government Code §6255(a), Times Mirror Co. v. Superior Court (1991) 53 Cal.3d 1325); and the preliminary drafts, notes and memoranda exemption (Government Code § 6254(a)).
Due to the voluminous number of records sought by your request, the City is still in the process of reviewing, compiling, and assembling records. The City anticipates that records will be made available to you by April 15, 2019.
