Greetings Teresa,
We request that your agency promptly provide a copy of all public records described below, in accordance with Cal. Gov’t Code § 7922.530(a):
Your logs, electronic or otherwise, tracking all requests made of your agency pursuant to the California Public Records Act, between January 1, 2024 and June 30, 2024. These records should include, at a minimum, the identity and contact information of each requestor (to the extent that information was provider) along with the text of their request(s).
For every responsive record you hold in an electronic format, we specifically request a copy of that record in its native format. Cal Gov’t Code § 7922.570(b)
This request includes “any writing containing information relating to the conduct of the public's business prepared, owned, used, or retained [by your agency] regardless of physical form or characteristics.” Cal. Gov’t Code § 7920.530(a)
We respectfully remind you that you are required to respond with the results of your search for these records within 10 calendar days, in all but “unusual” circumstances. That determination, in turn, must include an estimate of the date and time when the records will be made available to us. Cal. Gov’t Code § 7922.535
In every case, you must produce responsive records promptly, without delay or obstruction. Cal. Gov’t Code §§ 7922.530(a) and 7922.500
If you believe the above request does not reasonably describe an identifiable record or records, we request that you assist us in making a focused and effective request. This assistance must include your description of information technology and physical locations of actually and potentially responsive records, and you must provide us with suggestions for overcoming any practical basis for denying access to the records or information sought. Cal. Gov’t Code § 7922.600(a)(1)-(3)
Although we are not required to, we are providing you with the underlying purpose for our request, in order to assist you with your obligation to help us make a focused and effective request:
We want to document the nature and extent of all PRA requests to your agency during the six month period identified. The content of the request is more central to our inquiry than the status of your response, but we appreciate receiving both items wherever possible.
If you believe that some of the records we are requesting fall within a legal exception to their production, we request that you redact the information you are choosing to withhold while releasing “[a]ny reasonably segregable portion” of the record. Cal. Gov’t Code § 7922.525(b)
Of course, should you choose to redact or withhold any part of the records we have requested, we expect you to explain, in writing, the legal basis for your action. Cal. Gov’t Code § 7922.535
