The City is currently engaged in a competitive request for proposals process. Proposals and disclosure of proposers are not currently public record until staff makes a recommendation for approval of a proposal to the City Council in open session. See, Michaelis, et al. v. Superior Court, (2006) 38 Cal.4th 1065. Additionally, the information is protected by the deliberative process privilege. See, Times Mirror Co. v. Superior Court, (1991) 53 Cal.3d.1325.
