Re: Public Records Act Request—Hotel Development and Short Term Rentals

The City of Garden Grove ("City") has completed its review of your March 25, 2019, request for public records. This letter will serve as the City's notice of determination as to whether the request, in whole or in part, seeks the production of non-exempt, non-privileged disclosable public records in the possession and control of the City pursuant to the California Public Records Act (Government Code §§ 6250 et seq.) (the "Act"). The City has evaluated the 2 general request category descriptions set forth in your request in an effort to make a determination as to whether the request seeks copies of disclosable public records in the possession and control of the City. The City's determination in this regard is as follows:

Request 1. All the records related to the hotel developer Kam Sang for the hotel development off Harbor and Twintree.

This request is objected to on the grounds that, as phrased, is vague, overly broad and unduly burdensome. Note that in Rogers v. Superior Court, (1993) 19 Cal. App.4th 469, 481, the Court held that requests for public records must be focused and specific. Perhaps you might want to specify whether the records you are interested in relate to a specific issue or event involving the proposed development, and/or limiting your request to events occurring within specific dates.

Request 2. All the records related to all warning letters and violations for short term rental for all Garden Grove property owners that received them within the last 2 years.

A list of properties cited in the last 2 years for operating a short term rental will be provided in response to this request, please click on the link below to access document. No warning letter is available in response to this request, as warnings are not required for such violations.
