Dear Chief Elgin:

Under the California Public Records Act Government Code Section 6250 et seq., I am requesting an opportunity to inspect or obtain copies of any public records that:

* document the number of rape kits booked into Garden Grove Police evidence over the past 10 years, broken down by year

* document the number of rape kits booked into Garden Grove Police evidence that were sent to a public or private crime laboratory for testing over the past 10 years, broken down by year

* document the current total number of untested rape kits in any storage facilities currently under Garden Grove Police Department's jurisdiction and control

* document policies or procedures regarding Garden Grove Police Department practices on the handling of rape kit evidence, including testing protocols

If there are any fees for searching or copying these records, please inform me if the cost will exceed $200. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public's understanding of sexual assault. I am a news producer, and my request is for news gathering purposes. This information is not being sought for commercial purposes.

Dear Ms. McAfee:

The City of Garden Grove has received your records request dated September 7, 2016, in the City Clerk's Office on September 13, 2016, requesting information regarding rape kits booked into Garden Grove Police evidence over the past 10 years. This letter shall serve as notification of the City’s intent to comply with your request for public records, pursuant to the California Public Records Act (the “Act”) (Government Code §6250 et seq.).

The City is in the process of evaluating this request and is compiling records in an effort to make a determination as to whether the request seeks copies of disclosable public records in the possession of the City of Garden Grove. However, notice is hereby given that the time limit to make this initial determination under the code shall be extended by fourteen (14) days to October 7, 2016, pursuant to Government Code §6253, for the following reason:

(a) The extension of time is reasonable and necessary for the proper processing of the request.

As noted above, the City’s written determination as to whether the request seeks copies of disclosable, non-exempt and non-privileged public records in the possession of the agency shall be sent to you on or about October 7, 2016. Pursuant to the Act, thereafter any and all disclosable, non-exempt and non-privileged public records that are deemed responsive to your request will be made promptly available to you.
