Dear Sir/ Madam:

Under the California Public Records Act § 6250 et seq., I am requesting an opportunity to inspect or obtain copies of public records as follows:

1. How many current computer users are there in your organization?
2. Does your organization manage your own IT or is it outsourced?
3. How much was spent in total on IT product, software and during the last financial year?
4. How much was spent on software license (including Microsoft) in total during your last financial year?
5. How much was spent on last Microsoft software license contract? For how long? Can you break the value of the Microsoft contract for your last financial year individually?
6. Does your organization currently use a Software Asset Management tool? If yes, what is the name of the tool?
7. Does your organization currently use any form of software usage metering? If yes, what is the name of the technology that does this?
8. Who is responsible for the purchase and negotiation of software license in your organization?
If there are any fees for searching or copying these records, please inform me if the cost will exceed $10. However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of software usage costs within California local government as part of an international software efficiency benchmarking project. This information is not being sought for commercial purposes.

The California Public Records Act requires a response within ten business days. If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.

1. How many current computer users are there in your organization?
950 total users

2. Does your organization manage your own IT or is it outsourced?
The City manages its own I.T.

3. How much was spent in total on IT product, software and during the last financial year?
$1,320,255.87

4. How much was spent on software license (including Microsoft) in total during your last financial year?
$924,628.97

5. How much was spent on last Microsoft software license contract? For how long? Can you break the value of the Microsoft contract for your last financial year individually?
The City does not have any ongoing software license contracts with Microsoft.

6. Does your organization currently use a Software Asset Management tool? If yes, what is the name of the tool?
The City uses OpenAudit and Microsoft Volume Licensing Service Center to
manage our software assets.

7. Does your organization currently use any form of software usage metering? If yes, what is the name of the technology that does this?
No, but the City does regularly use OpenAudit to monitor appropriate software
usage.

8. Who is responsible for the purchase and negotiation of software license in your organization?

Dear Mr. Clark,

The City of Garden Grove has received your records request dated October 1, 2015, requesting information regarding the City's I.T. Department/Services. This letter shall serve as notification of the City’s intent to comply with your request for public records, pursuant to the California Public Records Act (the “Act”) (Government Code §6250 et seq.).

The City is in the process of evaluating this request and is compiling records in an effort to make a determination as to whether the request seeks copies of disclosable public records in the possession of the City of Garden Grove. However, notice is hereby given that the time limit to make this initial determination under the code shall be extended by fourteen (14) days to October 26, 2015, pursuant to Government Code §6253, for the following reason:

(a) The extension of time is reasonable and necessary for the proper processing of the request.

As noted above, the City’s written determination as to whether the request seeks copies of disclosable, non-exempt and non-privileged public records in the possession of the agency shall be sent to you on or about October 26, 2015. Pursuant to the Act, thereafter any and all disclosable, non-exempt and non-privileged public records that are deemed responsive to your request will be made promptly available to you.
